1. SCOPE
The following General Terms and Conditions (GTC) apply in the version valid at the time of the order for all contracts by Volker Müller (hereinafter Müller) with consumers in accordance with Section 13 BGB or companies in accordance with Section 14 BGB (hereinafter customer), which are made via the online shop come about on www.volkermuellershop.com. 4. CONCLUSION OF CONTRACT
The presentation of goods on the Internet does not constitute a binding contract offer volkermuellershop.com. The contract between the customer and Volker Müller only comes about through an order from the customer and its acceptance by Volker Müller. A confirmation of the receipt of the order does not constitute acceptance. In the event of acceptance, Volker Müller sends an order confirmation by e-mail. Sending the ordered goods to the customer is equivalent to an express declaration of acceptance. Customers who do not have their place of jurisdiction in Germany or who want a delivery outside the EU should contact customer service directly; an online order is not possible in these cases without prior special agreement. The delivery time and shipping costs can be found in the item description. Individually agreed delivery times take precedence.

5. Ordering Process
The customer can order from Volker Müller - (https://www.volkermuellershop.com/) by going through the following steps:
a. By clicking on the "Into the shopping cart" button, articles are placed in the shopping cart without obligation. All items that have been placed in the shopping cart can be viewed by clicking on "Your shopping cart / View your shopping cart". Articles can be deleted or the number changed and the shipping costs can be displayed here.
b. If you want to buy items from the shopping cart, you can click on "Continue to checkout" to go to the ordering process.
c. During the ordering process, customers who are already registered with Volker Müller and have not previously logged in can log in with their access data. New customers are asked to enter their order details individually and to register.
i.e. The "Login" button takes you to the shipping options. The shipping method can be selected here. Then click on "continue" to get to the payment method. Here you can choose from different payment methods.
e. Before the order is sent, you can access the control page by clicking the "continue" button. All data (in particular billing and delivery address, product, price, quantity, payment method) of the planned order are given again in an overview. There the data can
can also be corrected or changed.
f. The order is sent via the "Buy now" button. The conclusion of a purchase contract is thus bindingly offered by the customer. Please refer to the first paragraph of this point for information on when the contract was concluded. Further information on the ordering process can be found on the "Help and Service" pages.

6. Prices and shipping costs
The prices at the time of the order apply. All prices are in euros and are gross prices without exception, ie they include the statutory VAT and other price components and do not include shipping costs.
The delivery and shipping costs, the amount of which depends on the information provided in connection with the respective presentation of the goods, are incurred from the location. If the delivery is made to a customer outside of the Federal Republic of Germany, the delivery and shipping costs increase depending on the weight or volumetric weight.
For shipments outside the EU, additional costs such as e.g. B. Taxes and/or levies/duties incurred, which the customer has to bear.

7. Terms of Payment
Payment for deliveries within Germany can be made in advance, by PayPal or by credit card. Payment for deliveries outside of Germany is made in advance. When paying by invoice, Volker Müller reserves the right to request a down payment for higher order values.
Payment in advance
When paying in advance, the deadline for delivery begins no later than three working days (bank processing time) after the payment order has been issued to the transferring bank.
Payment by credit card via PayPal.
If the customer chooses to pay by credit card (American Express, Visa and MasterCard), the goods will be sent to the customer immediately. The credit card will only be debited after the goods have been sent to the customer.
Payment via PayPal
When paying via PayPal, the delivery period begins no later than one working day after the payment order has been issued to PayPal.
Payment by invoice
The goods will be sent to the customer immediately. The invoice amount is due immediately and without deduction.
Payment in cash or by debit card if you pick it up yourself
The customer can also pick up his goods himself from Volker Müller. Payment is made in cash or with an EC card. Shipping costs do not apply if you pick them up yourself. It is requested to announce the customer's visit by telephone to ensure that the goods are also available.

8. Terms of delivery and shipping
Within the Federal Republic of Germany, Volker Müller delivers the goods within five working days after receipt of the order. Any exceptions are indicated on the respective product page or arise due to individual payment methods (see point 7. Terms of payment). When shipping to other countries of the European Union and Switzerland, the courier needs up to seven additional working days.

9. Cancellation policy

Consumers are entitled to a right of withdrawal according to the following stipulations, whereby a consumer is any natural person who concludes a legal transaction for purposes that are predominantly neither commercial nor self-employed.

To meet the cancellation deadline, it is sufficient for you to send the communication regarding your exercise of the right of cancellation before the cancellation period has expired.
Consequences of revocation
If you withdraw from this contract, we will owe you all payments that we have received from you, including delivery costs (with the exception of the additional costs resulting from the fact that you have chosen a different type of delivery than the cheapest one offered by me/us have chosen standard delivery), immediately on which we received notification of your cancellation of this contract. For this repayment, we use the same means of payment that you used in the original transaction, unless something else was expressly agreed with you; under no circumstances will you be charged fees for this repayment.
We may refuse repayment until we have received the goods back or until you have provided proof that you have returned the goods, whichever is earlier.
You must return or hand over the goods to us immediately and in any case no later than fourteen days from the day on which you inform us of the cancellation of this contract. The deadline is met if you send back the goods before the period of fourteen days has expired. We bear the costs of returning goods that can be sent by parcel post.
You bear the direct costs of returning goods that cannot be sent as a parcel. These costs are estimated at a maximum of around EUR 75.00 within Germany and EUR 150.00 within the rest of the EU.
You are only liable for any diminished value of the goods resulting from the handling other than what is necessary to establish the nature, characteristics and functioning of the goods.
Please understand that there is no right of withdrawal for deliveries outside the European Union.

9.1.

With regard to all items offered in the shop, there is no right of withdrawal for the customer, since all items are manufactured individually and according to customer requirements.

The right of withdrawal does not apply to long-distance contracts for the delivery of customer-specific products that are not prefabricated and for the production of which an individual selection or determination by the consumer is decisive or which are clearly tailored to the personal needs of the consumer.

10. Retention of Title
The goods remain the property of Volker Müller until full payment has been made.

11. Warranty
If there is a defect in the purchased item, the warranty is based on the statutory provisions. The limitation period for statutory claims for defects is two years for consumers and begins on the date of delivery, ie receipt of the item by the customer. The warranty period for entrepreneurs is limited to one year.
Insignificant deviations in colour, dimensions and/or other quality and performance characteristics do not justify any claims by the customer.
For consumers and entrepreneurs, the above limitations of liability and limitation periods do not relate to claims for damages and reimbursement of expenses that the customer can assert under the statutory provisions due to defects in accordance with number 12.

12. Shipping Damage / Returns
If the customer acts as a consumer, the following applies: If goods are delivered with obvious damage to the packaging or the contents, we ask that you complain to the forwarder/freight service immediately and contact Volker Müller by telephone or in some other way so that Volker Müller can rights against the carrier/freight service.

We also ask that you return items to us in the original packaging.
Goods that were sent by a forwarding agent are generally picked up again by a forwarding agent in the event of a return. In this case, we ask that you contact Volker Müller by phone, in writing or by email. In order to avoid transport damage, we ask that you refrain from returning the goods by parcel service, because even in their original packaging, forwarding items are not automatically suitable for transport via a parcel service due to their weight, sensitivity or size.
Failure to comply with the above points does not limit your right of withdrawal as a consumer. In addition, failure to make a complaint or contact has no effect whatsoever on the statutory or contractual warranty and liability claims of the customer as a consumer.
If the customer acts as a merchant within the meaning of § 1 HGB, he is obliged to examine and give notice of defects according to § 377 HGB. The goods are deemed to have been approved if the customer fails to comply with the notification obligations regulated there.

13. Liability
Volker Müller is liable for damages and reimbursement of expenses in accordance with the statutory provisions. Liability for normal wear and tear and color deviations is excluded.

16. Returns & Exchanges

I do not accept returns and exchanges.

I do not accept cancellations. But please contact me if you have any problem with your order.

17. The following items cannot be returned or exchanged

Due to the nature of these products, no withdrawal is possible for the following products. The situation is different if the products were defective or damaged upon delivery.

Custom made or personalized orders
Digital downloads
color deviations
T-shirts and caps or hats, hoodies and mugs

If, exceptionally, a product from the portfolio is no longer available due to the respective manufacturer, Volker Müller reserves the right to temporarily use a replacement product that is at least of the same value. In individual cases, there may be slight deviations compared to the original product. This does not result in any additional costs for the customer, even if the replacement product is of higher quality.

In principle, buyers bear the shipping costs for returns. If the item is not returned in its original condition, the buyer is responsible for any loss in value. Volker Müller reserves the right to reject unsolicited returns to Volker Müller.

18. Final Provisions
The law of the Federal Republic of Germany. Mandatory regulations of the state in which customers who are consumers have their habitual residence remain unaffected. In transactions with consumers within the European Union, the law at the consumer's place of residence may also be applicable, provided that consumer law regulations are mandatory.
The validity of the United Nations Convention on Contracts for the International Sale of Goods (UN Sales Convention) is excluded, even in cross-border deliveries.

The place of jurisdiction for all legal disputes is Merseburg if the customer is a merchant, a legal entity under public law or a special fund under public law. If the consumer is not resident in Germany or in another country of the European Union, Merseburg is also the place of jurisdiction.

19. Exchange Return

These rules are an integral part of these General Conditions and were/are also expressly accepted when the order(s) were placed. I hereby confirm that I have read and accept all parts of these general terms and conditions.

20. Severability Clause
Should a provision in these terms and conditions or a provision within the framework of other agreements be or become invalid, this shall not affect the validity of all other provisions or agreements.
